Terms of Service

Welcome to GMHost. These Terms of Service constitute a legally binding agreement between you and GMHost. By accessing our platform, you agree to comply with each clause detailed herein to ensure a safe and professional experience.
1. Acceptance and Eligibility
By registering, accessing or using any service provided by GMHost, you acknowledge that you have read, understood and agree to be bound by these terms. If you do not agree with any part of this document, you must not use our services.
Our services are intended exclusively for individuals over 18 years of age or legally constituted entities. By creating an account, you represent that you have the legal capacity to enter into binding contracts and that all information provided is truthful, complete and up to date.
GMHost reserves the right to modify these terms at any time. Notifications of changes will be made through our control panel or via the email address associated with your account. Continued use of the services after such modifications constitutes your acceptance of the new terms.
2. User Accounts and Security Responsibilities
You are solely responsible for maintaining the confidentiality of your access credentials, including passwords, API keys and SSL/TLS certificates. Any activity carried out under your account will be considered your direct responsibility, regardless of whether it was authorized by you or not.
You are responsible for keeping your personal data up to date, including contact and tax information.
GMHost implements robust security measures in its infrastructure, but application-level security and account access security falls on the client. The use of weak passwords or failure to protect access credentials releases GMHost from any liability for security breaches.
Client responsibilities:
• Report unauthorized access within the first 24 hours. Otherwise, GMHost is released from any liability.
• Keep contact and tax information 100% up to date.
• Do not share account access or sub-accounts with unauthorized third parties.
• Ensure that sub-users fully comply with these terms.
• Perform periodic audits of permissions granted in your panel.
Recommended security practices:
• Two-Factor Authentication (2FA) via TOTP or WebAuthn is recommended.
• Periodic password rotation for administrative accounts is recommended.
• Prohibition of storing credentials in plain text.
Note: GMHost will never ask for your password via email, chat or phone. Any such communication must be reported immediately as a phishing attempt.
3. Acceptable Use Policy (AUP)
Our network is designed to host legitimate, productive, high-performance projects. Use of our resources for malicious, illegal or degrading activities will result in immediate termination without notice and, where applicable, notification to the competent authorities.
This Acceptable Use Policy (AUP) applies to all GMHost services, including Minecraft hosting, VPS, dedicated servers, storage, IP addresses, private networks, backups and any auxiliary resources delivered to the client.
GMHost maintains proactive monitoring of network, CPU, memory, disk, I/O, outgoing traffic, IP reputation and connection patterns. Detection of anomalous traffic, sustained use of unsubscribed resources or behaviors consistent with abuse will trigger automatic mitigation, limitation or preventive suspension protocols.
Cybercrime: hosting, distributing, facilitating or coordinating malware, phishing, credential theft campaigns, DDoS attacks, botnets, C&C servers, exploit kits, IP spoofing, port scanning, brute force, credential stuffing or any unauthorized hacking activity is strictly prohibited.
Network and email abuse: GMHost has zero tolerance for SPAM (UCE), mail bombing, mass scraping, open SMTP relays, anonymous proxies, Tor exit nodes, tunnels used to hide abuse, mailing lists without double opt-in or any activity that deteriorates the reputation of our IPs or affects third parties.
Hardware and resource abuse: using shared services, VPS, dedicated servers or game nodes for workloads that degrade the availability of other clients or exceed the contracted purpose is prohibited. This includes deliberate saturation of CPU, memory, disk, network, IOPS, NVMe, data bus, fork bomb processes, unscheduled stress testing, sustained benchmarks or massive video encoding/transcoding without prior authorization.
Cryptocurrency mining and similar workloads: mining with CPU, GPU, disk, storage or network, whether direct or indirect, is prohibited. The prohibition includes Monero mining, Ethereum forks, Chia/plotting by intensive SSD wear, private pools, mining proxies, validators or nodes performing undeclared intensive computation, distributed computing such as SETI/Folding and any process designed to convert contracted resources into computational performance unrelated to the permitted service.
Minecraft services: normal use of CPU, RAM, disk and network associated with the game, plugins, mods, backups and reasonable administrative tools is permitted. Hiding miners inside plugins, mods, jars, scripts, cron jobs, containers, panels, bots or secondary processes is not allowed. If a compromised modpack or plugin initiates mining or abusive traffic, the service holder remains responsible for correcting it immediately.
Research and security: penetration testing, scanning, stress tests, malware laboratories, honeypots or similar activities are only permitted with prior written authorization, defined scope, agreed time window and technical limits approved by GMHost.
Consequences: serious AUP violations may result in immediate suspension, termination without refund, removal of abusive processes, port blocking, null-route, IP revocation, administrative charges for reputation cleaning or notification to authorities and antispam entities where applicable.
4. Payments, Billing and Suspension
GMHost operates under a strict prepayment model. Service provision is conditional upon effective receipt of funds corresponding to the contracted period.
Non-payment and suspension timeline:
• Day 0 — Invoice due date: first non-payment notice.
• Day 1 — Service suspension: network suspension.
• Up to day 5 — Data hold: data preserved (with extra reactivation fee).
• Day 5 — Final deletion: irreversible disk wipe.
Payment methods: we accept credit/debit cards, SEPA bank transfers, PayPal and selected cryptocurrencies. Payments via transfer may take up to 72 hours to process.
Taxes: all prices shown are subject to applicable VAT in Spain (21%) for EU residents, unless a valid VIES is provided.
Fraud and disputes: initiating a chargeback results in immediate account closure and an administrative penalty of €50 per dispute opened to cover management costs.
Automatic renewals: by default, services renew automatically. It is the client's responsibility to disable this option at least 48 hours before expiration.
5. Limitation of Liability
GMHost provides its services "as is" and "as available". We do not guarantee that the service will be uninterrupted, error-free or completely secure, although we apply industry best practices.
In no event shall GMHost be liable for loss of data, lost profits or indirect damages arising from the use of our services. It is the client's sole responsibility to maintain external and up-to-date backups of their information.
GMHost's total liability for any contractual claim shall not, in any event, exceed the amount paid by the client for the specific service during the three months prior to the incident.
6. Intellectual Property
All content, brands, logos, source code and network architecture are the exclusive property of GMHost or its licensors. Use of our services does not grant any ownership rights over these elements.
You retain all rights to the data and applications hosted on our servers. However, you grant us a limited license to process such information solely for the purpose of providing the contracted service.
GMHost reserves the right to use your name, logo and brand for advertising and promotional purposes, unless the client expressly objects in writing.
7. Termination, Suspension and Effects
You may cancel your services at any time from the control panel. Cancellation will take effect at the end of the current billing cycle.
GMHost reserves the right to suspend, limit or unilaterally terminate this agreement immediately if a serious violation of these terms, fraud, non-payment, network abuse, mining, illegal use, risk to third parties or impact on infrastructure stability is detected.
Preventive suspension may be applied without prior notice when necessary to contain attacks, preserve evidence, prevent damage to other clients, comply with legal obligations or protect the reputation of our IP addresses.
Cancellation or termination of service does not release the client from outstanding debts, administrative charges, abuse liabilities, third-party claims or reasonable costs arising from reputation cleaning, technical investigation or incident response.
8. Service Scope and Resource Usage
When contracting a service, GMHost delivers access to specific technical resources according to the selected plan. Commercial specifications, allocated CPU, RAM, storage, traffic, bandwidth, slots, location, backups, DDoS protection and applicable support are defined in the product sheet, invoice, client panel or personalized proposal.
Resources indicated as shared, fair use, burst, best effort or equivalent do not constitute unlimited dedicated capacity. GMHost may apply reasonable limits, prioritization, throttling or technical migration if a client's sustained consumption degrades the experience of other users or exceeds the intended use of the contracted product.
Game hosting services are intended to run game servers, panels, backups, plugins, mods and reasonable auxiliary tasks. They must not be used as a general computing platform, proxy, mass storage, CDN, tunnel, relay, scraping, abuse laboratory or infrastructure unrelated to the contracted service.
9. Content and Software Responsibility
The client is responsible for all content, software, configurations, users, scripts, keys, passwords, plugins, mods, databases and processes executed on their services, even when installed by third parties, collaborators, sub-users or through compromised credentials.
GMHost does not proactively review private service content, but may inspect technical metadata, processes, connections, resource usage, network logs and elements strictly necessary for support, security, abuse prevention, legal compliance or incident investigation.
The client declares that they have sufficient licenses, permissions and rights to host, run or distribute any software, brand, content, modpack, plugin, file, database or copyrighted material within GMHost's infrastructure.
10. Backups, Retention and Data Loss
Unless expressly stated otherwise in the plan, backups offered by GMHost are an operational convenience measure and do not replace the client's obligation to maintain external, verifiable and up-to-date backups.
GMHost does not guarantee full data recovery in the event of accidental deletion, corruption caused by client software, attacks, compromised credentials, faulty plugins, non-payment, suspension for abuse, force majeure or failures beyond our reasonable control.
After cancellation, expiration, prolonged suspension or termination for abuse, GMHost may delete data, snapshots, backups, images, databases and configurations associated with the service according to published deadlines or security and compliance needs.
11. IP Addresses, Network and Reputation
IP addresses, ranges, reverse DNS, routes, DDoS mitigation, firewall rules and network configuration assigned to the client remain resources managed by GMHost or its providers. Their assignment is temporary and does not transfer ownership to the client.
GMHost may change, withdraw, filter, announce, unannounce, null-route or reassign IP addresses when necessary due to abuse, reputation, maintenance, provider requirements, routing decisions, resource exhaustion, product changes or legal compliance.
The client may not announce GMHost IPs on external networks, modify routes, perform spoofing, resell addresses, operate abusive anonymization services or use the network to evade blocks, sanctions, blacklists or third-party controls.
12. Technical Support and Customer Cooperation
GMHost support covers infrastructure availability, network, hardware, panel, service access and reasonable guidance on the contracted product. It does not include custom development, full system administration, advanced plugin debugging, modpack optimization, programming, forensic recovery or third-party software support unless specifically agreed.
Published response times are operational targets and not absolute guarantees, unless a contracted SLA expressly states otherwise. Ticket priority may be adjusted based on actual impact, severity, client availability to collaborate and technical evidence provided.
To receive effective support, the client must provide truthful information, logs, screenshots, timestamps, service IDs and reproduction steps. Manipulation of evidence, concealment of abusive processes or repeated refusal to cooperate may limit support or result in suspension.
13. Third-Party Software and Providers
GMHost may integrate or facilitate access to software, panels, APIs, payment processors, registrars, datacenter providers, carriers, antispam systems, DDoS mitigators and other third parties necessary to provide the service.
Use of third-party components may be subject to licenses, additional terms, technical limitations, price changes, provider suspension or unavailability beyond GMHost's control. The client agrees to comply with such conditions where applicable.
GMHost shall not be liable for failures, vulnerabilities, changes, removals, blocks or incompatibilities of third-party software, mods, plugins, jars, operating systems, images, libraries, external APIs or services controlled by the client.
14. Force Majeure, Notices and Entire Agreement
GMHost shall not be liable for breaches, delays or unavailability caused by events beyond its reasonable control, including natural disasters, fires, general power outages, labor conflicts, mass provider failures, extraordinary scale attacks, governmental acts, wars, pandemics, global internet failures, sanctions or legal requirements.
Official communications may be made via email, client panel, ticket system, status page, website notices or any contact channel registered on the account. It is the client's responsibility to keep their contact details updated and review relevant notifications.
GMHost may assign, transfer or subcontract all or part of operational obligations, infrastructure or contracts to related companies, providers or commercial successors, always seeking to maintain service continuity and the essential guarantees applicable to the client.
These terms, together with the Privacy Policy, Refund Policy, SLA, Abuse Policy, invoices, product descriptions and specific written agreements, constitute the complete agreement between GMHost and the client regarding the use of the services.
15. Governing Law and Jurisdiction
These terms are governed by the laws of Spain. Any dispute relating to these terms or the use of our services shall be submitted to the exclusive jurisdiction of the competent courts of Madrid, Spain.
If any provision of these terms is declared invalid by a court, that provision shall be removed without affecting the validity and enforceability of the remaining provisions.
